Job Offer Letter: 3 Templates and What to Include (2026)

Updated October 8, 2026 7 min read 7 sources
Quick answer

A job offer letter is the employer's written offer to a selected candidate. It states the job title, manager, start date, pay rate and schedule, overtime status, main benefits, any contingencies such as a background check, an at-will statement where it applies, and a deadline to accept. Keep it clear and specific, and have HR or an employment attorney review your template.

Key takeaways

  • Every offer letter should state the title, pay, start date, schedule, overtime status and a response deadline.
  • An at-will statement and careful wording help avoid promises that read like a guaranteed contract.
  • Background checks and post-offer medical exams come with federal rules, so list contingencies clearly and follow them.
  • Candidates should check pay, start date, contingencies and any signed agreements before they accept.

What is a job offer letter?

A job offer letter is the formal, written version of a job offer. It usually follows a phone call from the recruiter or hiring manager and gives the candidate the details they need to say yes: role, pay, schedule, start date and conditions.

For employers, it sets expectations in writing. For candidates, it is the document to review carefully before accepting. This guide is general information for employers; for a specific situation, talk with HR or an employment attorney.

How do you write an at-will statement in an offer letter?

In most states, employment without a written contract is generally at will, meaning either side can end it at any time for any lawful reason. A BLS review of the at-will doctrine notes that courts in many states recognize an implied contract exception, which is why wording matters.

“Your employment with Fabrikam is at will. This means that either you or the company may end the employment relationship at any time, with or without cause or notice. Nothing in this letter creates a contract of employment for any specific period.”

Leave out promises like “permanent position,” “job for life” or “guaranteed annual review raise.” Also note that Montana limits at-will employment by statute, so employers there should get local advice.

What contingencies can a job offer letter include?

ContingencyWhat to know
Background checkUnder the FCRA, you need a stand-alone written disclosure and the candidate’s written permission before ordering a report from a screening company. Before withdrawing an offer because of it, you must give a pre-adverse action notice with a copy of the report and a summary of rights (FTC and EEOC).
Medical examUnder the ADA, an employer may require a medical exam only after a conditional job offer, must require it of all entering employees in the same job category, and must keep results confidential (EEOC).
Reference checkState that the offer depends on satisfactory references, if it does.
License or certificationName the license and the date it must be current, such as a state RN license.
Drug testCheck state and local rules before you add one.
Signed agreementsName any confidentiality or other agreement the candidate must sign.

Form I-9: Every new hire completes Form I-9. Employees must complete Section 1 no later than their first day of employment (USCIS), and employers must complete Section 2 within 3 business days of the date of hire (USCIS). Your offer letter can remind the new hire to bring acceptable documents on day one.

Unpaid internships: At for-profit employers, the Department of Labor uses a “primary beneficiary test” to decide whether an intern is really an employee who must be paid (Fact Sheet #71). Factors include whether the internship is tied to the intern’s education and whether the intern’s work supplements, rather than replaces, paid staff. Get legal advice before offering an unpaid internship.

What should candidates check before signing a job offer letter?

  • Pay: Is the amount, pay frequency and overtime status what you discussed? If the letter says hourly, our overtime calculator shows what extra hours are worth.
  • Title and manager: Do they match the role you interviewed for?
  • Start date and schedule: Can you give proper notice at your current job?
  • Location: Is the remote or hybrid arrangement in writing?
  • Contingencies: What has to happen before the offer is final?
  • Benefits start date: Will you have a gap in health coverage?
  • Other agreements: Read any confidentiality, noncompete or repayment terms before you sign.

If the numbers are not right, negotiate before you accept. When you are ready, send a job offer acceptance email that confirms the key terms. If the offer is not a fit, here is how to decline a job offer without burning a bridge.

Common job offer letter mistakes employers make

MistakeBetter approach
Stating pay without the pay period“$72,000 per year” or “$19.50 per hour”
Leaving out exempt or nonexempt statusState overtime status clearly
Promising “permanent” employmentUse an at-will statement where it applies
Vague contingenciesName each check and who conducts it
No response deadlineGive a specific date
Mismatched details across documentsMatch the offer, HR system and payroll

Accurate offer letters also make later paperwork easier, from an employment verification letter for a new hire’s apartment application to a termination letter if the job ends.

Frequently asked questions

Is a job offer letter legally binding?

Usually an offer letter is not a guaranteed employment contract, especially when it includes an at-will statement. However, promises about pay, bonuses or job security can create obligations in some situations. Have an employment attorney review your template if you are unsure.

What is the difference between an offer letter and an employment contract?

An offer letter summarizes the main terms of a job and is usually short. An employment contract is a more detailed agreement that may set a fixed term, termination conditions and other obligations. Many US jobs use only an offer letter.

Can an employer take back a job offer?

In many at-will situations, an employer can withdraw an offer, but the reason cannot be illegal, such as discrimination. Withdrawing an offer because of a background report from a screening company also triggers notice requirements under the Fair Credit Reporting Act. Specific situations vary, so talk with an employment attorney.

How long should a candidate get to accept a job offer?

There is no single rule. Many employers give a few business days to a week. A clear deadline in the letter helps both sides, and candidates can ask for more time if they need it.
